3.Child Marriage.

Muhammad married a child of six and encouraged his followers to marry young children.  The following hadiths attest this:

‘…. A rider came behind me. I looked back and saw that the rider was Allah's Apostle . He said (to me), "What makes you in such a hurry?" I replied, "I am newly married." He said, "Did you marry a virgin or a matron?" I replied, "(Not a virgin but) a matron." He said, "Why didn't you marry a young girl with whom you could play and who could play with you?" (Bukhari Vol.7, Bk. 62, H. 172, Bukhari, 17).

"Why did you not marry a young girl who would have fondled with you?" I replied, "O Allah's Apostle! My father was martyred on the day of Uhud and left nine (orphan) daughters who are my nine sisters; so I disliked to have another young girl of their age, but (I sought) an (elderly) woman who could comb their hair and look after them." The Prophet said, "You have done the right thing."( Bukhari, Vo.5, Bk.59, H.382).

“Khadija died three years before the Prophet departed to Medina. He stayed there for two years or so and then he married 'Aisha when she was a girl of six years of age, and he consumed that marriage when she was nine years old”. (Bukhari, Volume 5, Book 58, Number 236).

‘And as for those of your women who have despaired of menstruation, in case you have any suspicion, then their (fixed) spell shall be three months, (along) with those who have not menstruated (as yet) because of their young age their period shall also be three months. Quran 65:4: (Tafsir al Jalalyn).

Those who have not even started menstruation, like Aisha, have been allowed to be married in Islam. However Muhammad did not allow this for his own daughter Fatima. That shows that it was not a commonly accepted practice.

"Abu Bakr and 'Umar, may Allah be pleased with them, proposed marriage to Fatimah but the Messenger of Allah said: 'She is young.' Then 'Ali proposed marriage to her and he married her to him." (Grade: Sahih, Sunan an-Nasa’I 3221, Bk. 26, H. 26).

Child marriage in Islam is not between two children as it had been in Hindu religion, but with a male who is old enough to be father or grandfather of the girl child. It is very reprehensible in any culture and society.

4.Sex with Children

Ayottullah Khomeini the supreme leader of Shia’t community in Iran made this ruling: Ruling #12:

‘It is not permission to have intercourse before (her) being 9 years old, be it in nikkaah (permanent marriage) or temporary marriage. And As for all other pleasures such as lustful touch, embracing, and thighing, there is no problem in it even with a suckling infant. If he does have sexual intercourse before nine years of age and does not penetrate, there is no penalty, but he has committed a sin. If he does penetrate causing the vagina and urethra openings to be one, she will become forever haram for him, but this is as a precaution. And it is more probable that her status as his wife is not removed. And the rulings of inheritance, and the prohibition of a fifth wife or marriage to her sister applies. And it is waajib upon him for her maintenance as long as she is alive, even if he divorces her and even if she marries after divorcing her as a precautionary measure. And it is waajib upon him for blood money for the penetration and the amount is equivalent to that of an individual. If she is a free-woman, the amount is half that of a man, plus the dowry that she became entitled to through the `aqd and penetration. If he penetrates his wife after the age of nine, she does not become haram to him and there is no evidence that blood money is liable, but as a precautionary measure, he should maintain her as long as she is alive, although it is more probable that this is not obligatory."

It isn't only al-Khomeini who has done this fatwa, Ali- al-Sistani (Religious leader of Shi’as in Iraq) has also said this fatwa almost verbatim (a few minor changed) in his Minhaaj al-SaaliHeen.
