46.Halal Marriage:

Islam dictates that a Muslim man has the liberty to divorce and remarry the same woman twice. However, if he divorces (‘Talak)’ three times, he can only remarry the same woman only if she first marries another man, consummates the marriage, and only if the man dies or willingly asks for divorce, can the woman go back to her former husband and remarry him.

“from the Prophet, concerning a man who had a wife then divorced her, then another man married her but divorced her before consummating the marriage. Could she go back to the first man? He said: “No, not until he tastes her sweetness.” (Sahih Sunan Ibn Majah 1933, Bk. 9, H. 89).

Often Muslim men divorce wives in triple “Talak” in quick succession and later regrets the action. But then they cannot remarry until the woman gets married to another man and that man in turn  divorces her after consummating the marriage. However, if it is done intentionally to convenience the remarriage with her former husband, then it is invalid. The marriage with the second man is called Halal marriage or Tahleel marriage. Since this second marriage makes it possible for the woman to marry her first husband again.

“And if he has divorced her (the third time), then she is not lawful unto him thereafter until she has married another husband. Then, if the other husband divorces her, it is no sin on both of them that they reunite, …” [al-Baqarah 2:230].

If this second marriage with the second man is done with a purpose to make her legal to go back to her first husband or if the second husband is aware that this marriage is a Halal marriage, then  it is an invalid marriage according to many scholars of Islam, and it was repudiated by Muhammad. Then the woman does not become permissible to her first husband by means of this haram (unlawful) marriage, even if the second husband had intercourse with her which was one of the stipulations of the halal marriages. (there are several agencies in many countries helping with this Halal marriages).

The strange thing in this is that the man who divorced the woman in the first place has no impediment of getting another marriage or a halal marriage. It binds only on the woman. Even though it was the man who did the divorce in his temper tandrum. It is all because men have all rights and women have none.

47.The woman who arranges her marriage is adulteress:

Muhammad said: “No woman should arrange the marriage of another woman, and no woman should arrange her own marriage. The adulteress is the one who arranges her own marriage.”(Sahih, Sunan Ibn Majah 1882, Bk. 9, H. 38).

48.Women may not pray in the Mosque but at home.

"Do not prevent your women from visiting the mosques; but their houses are better for them (for praying)."(No. 567) (See also No. 570)

Women’s place is in the back of the Mosque (Sahih Muslim Vol.1, Bk. 4, No. 880-881).

"One of you who believes in God and in the Last Day should not raise her head until the men raise their heads (after prostration) lest she should see the private parts of men."(Sunan Abu Dawud, No. 850).

49. No maintenance allowance for wives:

Fatima bint Qais reported that her husband al-Makhzulmi divorced her and refused to pay her maintenance allowance. So she came to Allah's Messenger (may peace he upon him) and informed him, whereupon he said: There is no maintenance allowance for you, and you better go to the house of Ibn Umm Maktum and live with him for he is a blind man and you can put off your clothes in his house (i.e. you shall not face much difficulty in observing purdah there)”. (Muslim Book 9, Number 3514).

50.No permission to fast without husband’s permission:

Muhammad said, "It is not lawful for a woman to observe an optional Saum (fast) without the permission of her husband when he is at home. Nor should she allow anyone to enter his house without his permission." (Riyad as-Salihin 1750, Bk. 17, H. 240).

51.Women are forbidden to wear wigs of artificial hair. (Bukhari vol.7, no.133; Sahih Muslim vol.3bk.22, H. 5297-5306).

"A woman came to the Prophet and said:, My daughter is going to get married, and she had the measles and her hair has fallen out. Can I put extensions in her hair?, The Messenger of Allah said: ‘Allah has cursed the one who does hair extensions and the one who has that done.'" (Sahih, Sunan Ibn Majah 1988, Bk.9, H. 144)
